1. Introduction
These Terms of Service (“Agreement”) govern the use of the SaaS website audit tools and related services (the “Service”) provided by Myseoauditor (“we”, “us”, “our”) through myseoauditor.com (“Website”). By registering for or using the Service, the user (“Client”, “you”) agrees to be bound by these terms. Please print or download a copy for your records. The latest version supersedes all previous versions.
2. Definitions
- Account: The user’s personal account registered to access the Service.
- Agreement: This document, including any referenced policies and subsequent amendments.
- Client: The individual or legal entity registering for the Service.
- Service: Access and rights to use the Myseoauditor website audit solution and related applications in SaaS mode.
- Subscribed Plan: The monthly or annual plan chosen by the Client, as reflected in the Account dashboard.
- Personal Data: Information relating to an identified or identifiable natural person.
- Content: All data, personal or otherwise, processed through the Service.
3. Purpose of the Agreement
This Agreement sets forth the conditions for Myseoauditor to provide access to the Client, who gains a non-exclusive, non-transferable right to use the Service. In exchange, the Client agrees to pay all applicable fees and comply with this Agreement.
4. Service Description, Access, and Availability
- Myseoauditor is a website audit and lead generation tool, embeddable on client websites.
- The Client understands they are responsible for backing up their data. Myseoauditor is not responsible for data loss.
- Access requires full legal name, valid email, and other information as prompted. Each Account is for use by a single user only. Clients are responsible for credentials and account security.
- The Service is generally available 24/7. Support is in English via support@myseoauditor.com. Documentation and FAQs are available via our help center.
5. Data and Privacy
- Myseoauditor does not sell Client or Client contacts’ Personal Data.
- Authorized employees may access data solely to support clients.
- The Client is responsible for securing appropriate permissions to import or process third-party Personal Data.
- All data handling is governed by the Myseoauditor Privacy Policy.
6. Pricing, Payments, and Billing
- Pricing details are published on myseoauditor.com/pricing, with trial periods and multiple plan options.
- Subscribed Plans are billed in advance (monthly/annually) via credit card (Visa, Mastercard, Amex) and payment providers (e.g., Stripe, PayPal). All amounts are exclusive of taxes.
- No refunds are available for partial use, early cancellation, or unused periods within a billing cycle.
- Service features may be suspended for late or failed payments.
7. Service Modifications
Myseoauditor may modify or discontinue the Service (or aspects of it) at its discretion, with or without notice. Changes to pricing do not affect current billing cycles, only future renewals.
8. Terms of Use and Termination
- Agreements begin once an Account is created and continue until terminated by either party.
- Subscribed Plans automatically renew unless cancelled at least 7 business days before the end of the plan period. No refunds are provided after cancellation.
- Upon termination, Client data is deleted and not recoverable.
- Myseoauditor may suspend or terminate the Service for breach of this Agreement after notification and grace period.
9. Myseoauditor Responsibilities
- Myseoauditor will provide the Service as described, subject to payment and availability.
- Maintenance and upgrades may cause temporary interruptions; Myseoauditor will notify clients in advance when possible.
- Responsibilities for specialized support, training, or custom work must be arranged as separate agreements.
10. Client Responsibilities
- The Client must provide accurate, complete information and ensure compliance with all laws and regulations.
- Accounts may not be registered or used by bots or automated methods.
- The Client will not share, resell, or misuse the Service or Content.
- The Client agrees not to reverse engineer, hack, or attempt to gain unauthorized access.
- The Client is responsible for any damages caused to Myseoauditor, third parties, or the Service through Account misuse.
11. Liability
- The Service is provided “as is” and “as available.”
- Myseoauditor is not liable for data loss, service suspension, or indirect damages, including loss of earnings or data.
- The maximum aggregate liability shall not exceed the fees paid by the Client during the ongoing Subscribed Plan.
12. Intellectual Property
- Myseoauditor retains all rights in its tools, software, website, and related content.
- Clients retain rights over their own uploaded data and content.
- The Client agrees not to infringe, misuse, or misrepresent any Myseoauditor intellectual property.
- The Client will indemnify Myseoauditor against third-party claims of infringement relating to Client data or misuse.
13. Confidentiality
Both parties agree to keep all non-public information and materials confidential except as required to provide or use the Service, or as required by law.
14. Data Protection and GDPR
- Clients are considered data controllers for their own client/user data.
- Clients are responsible for compliance with all applicable data protection laws.

15. Force Majeure
Myseoauditor is not responsible for interruptions caused by events outside of its reasonable control, including but not limited to natural disasters, strike, network failures, or force majeure events.
16. Miscellaneous
- Myseoauditor reserves the right to assign or subcontract its contractual obligations.
- This Agreement supersedes all previous negotiations or understandings.
17. Governing Law and Jurisdiction
This Agreement is governed by the laws of Canada. Any dispute shall be resolved exclusively by the courts of the Province of British Columbia.
